- Eligibility: Promotion (the ‘60-Day Challenge’ or ‘Promotion’ or ‘Fundraiser’) is void where prohibited by law. Only members (the ‘participants’) of the Trim Down Club (the ‘Sponsor’) are eligible for Donation as a result of participation.
- Agreement to Rules: By participating, you agree to be fully unconditionally bound by these Rules, and you represent and warrant that you meet the eligibility requirements set forth herein. In addition, you agree to accept the decisions of the Trim Down Club, as final and binding as it relates to the content.
- 60-Day Challenge Period: Donation claims will be accepted starting on Monday, January 5th, 2015 at 12:01 AM PDT and ending on Friday, March 6, 2015 at 11:59 PDT.
- How to Enter: Enter the 60-Day Challenge by submitting a request via email to success@trimdownclub.com or registering via the 60 Day Challenge Registration Page. Members are allowed, and encouraged, to send or post before and after pictures over the course of this contest. The entry must fulfill all 60-Day Challenge requirements, as specified, in order for donations to be made to the specified charity. Entering the 60-Day Challenge constitutes permission for the Trim Down Club to use all participants names, photos, and stories for purposes of advertising and trade without further compensation. Entries that are not complete or do not adhere to the rules or specifications may be disqualified at the sole discretion of the Trim Down Club.
- Prizes: Every participant that meets the fundraiser rules will have a donation made by the Trim Down Club to Spoons Across America. No substitution of donation or transfer/assignment of donation to others or request for the cash equivalent by participants is permitted.
- Validation of Claims: Participants must report via email to success@trimdownclub.com their Trim Down Club username or registration email address along with the amount in lbs of weight lost. Only members with valid accounts will have donations made based on their claims.
- Donation: Members may claim up to but no more than 20 lbs of weight loss over the 60 days challenge period for donation. The Trim Down Club will match $1 for each pound of weight loss achieved using the Trim Down Club program and 60 day challenge materials. The validation of any claim to above 20lbs of weight loss(equaling a $20 donation) will be at the sole discretion of the Trim Down Club and evaluated on a case by case basis.
- Maximum Donation Allotment: Trim Down Club has a set goal to donate $5,000. The final donation will not exceed $5,000 regardless of reported member weight-loss. An increase of the maximum donation shall be decided at the complete discretion of Trim Down Club.
- Facebook page: Members who participate on the Trim Down Club 60 day challenge Facebook page located at https://www.facebook.com/Trimdownclub60DayChallenge will agree to abide by the conditions set forth by Facebooks terms and conditions and in this paragraph:
- The participant agrees to completely release Facebook of all responsibility to their activities during the Trim Down Club 60 Day Challenge.
- The participant acknowledges that the promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook.
- No post shall slander or contain any form of defamation to B2C Media Solutions, trimdownclub.com, the Trim Down Club program, Trim Down Club affiliates or Facebook.
- Members who take part in the Facebook page are permitted to provide external links as informational sources only. No links to external commercial sites may be posted without the explicit permission of the Sponsor. (Ambien)
- Users are not permitted to generate a profit from participation in the challenge without explicit written permission from the Sponsor.
- Inappropriate content shall be deemed so at the sole discretion of trimdownclub.com or Facebook and are grounds for immediate removal.
- Content flagged as inappropriate or plagiarized will be removed immediately, and the Sponsor reserves the right to ban these users from the page.
- The Sponsor reserves the right to cancel the 60 Day Challenge at any time; however, retains the rights of all submitted materials.
- In the event of cancellation, the Charity will receive amounts claimed up to the date of cancellation.
- Ownership of content supplied by participants: Sponsor will be the sole owner of all rights including full copy and intellectual rights of submitted photos and content to the Facebook page.The contribution of donation offered in this 60-Day Challenge is conditional upon compliance with any and all federal and state laws and regulations, and that the participant responds back with a proper mailing address within ten (10) days. ANY VIOLATION OF THESE OFFICIAL RULES BY ANY WINNER (AT SPONSOR’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS A WINNER OF THE 60-DAY CHALLENGE AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
- Rights Granted by you: By entering this contest you understand that the Trim Down Club and anyone acting on behalf of the Trim Down Club or its respective licensees, successors and assigns will have the right, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, the entry and name, portrait, picture, voice, likeness, image or statements about the 60-Day Challenge, and biographical information as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
- Terms: The Trim Down Club reserves the right, in its sole discretion to cancel, terminate, modify or suspend the 60-Day Challenge should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the 60-Day Challenge. In such case, the Trim Down Club may select the recipients from all eligible entries received prior to and/or after (if appropriate) the action taken by the Trim Down Club, and reserves the right at its sole discretion to disqualify any individual who tampers or attempts to tamper with the entry process or the operation of the 60-Day Challenge or website or violates these Terms & Conditions.
The Trim Down Club has the right, in its sole discretion, to maintain the integrity of the 60-Day Challenge, to void votes for any reason, including, but not limited to; multiple entries from the same user from different IP addresses; multiple entries from the same computer in excess of that allowed by 60-Day Challenge rules; or the use of bots, macros or scripts or other technical means for entering.
Any attempt by an entrant to deliberately damage any web site or undermine the legitimate operation of the 60-Day Challenge may be a violation of criminal and civil laws and should such an attempt be made, the Trim Down Club reserves the right to seek damages from any such person to the fullest extent permitted by law.
By entering the 60-Day Challenge you agree to receive email newsletters periodically from the Trim Down Club. You can opt-out of receiving this communication at any time by clicking the unsubscribe link in the newsletter. - Disputes: As a condition of participating in this 60-Day Challenge, participant agrees that any dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys’ fees, other than participant’s actual out-of-pocket expenses (i.e. costs associated with entering this 60-Day Challenge), and participant further waives all rights to have damages multiplied or increased.
